1. Introduction
1.1 These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you (the “User”) and Telmobil Inc, operating under the brand Simigo.ai, concerning your use of:
Our eSIM as a Service platform providing international and IoT connectivity (“eSIM Service”), and
Our AI SaaS platform (“AI Service”) for AI-powered content creation, automation, analytics, and API integrations.

1.2 Your use of the Simigo.ai website (simigo.ai), AI SaaS (app.simigo.ai), Mobile App developed or published by Telmobil Inc, toll free or virtual number requests or any related mobile app or APIs constitutes acceptance of these Terms.
1.3 We recommend you print or save a copy for future reference.
2. Registration
2.1 Users must register through our platform or application to access Simigo’s Services.
2.2 You must provide accurate and up-to-date information and agree to our Terms of Use, Privacy Policy, and Cookies Policy.
3. Purchase and Activation of eSIM
3.1 When you purchase an eSIM or data plan, you agree to pay the applicable charges.
3.2 You are responsible for ensuring your device is unlocked and eSIM-compatible.
3.3 eSIMs may be purchased directly from Simigo or authorized partners.
3.4 Data Plans are available for over 180 countries and may include regional or IoT-specific plans.
3.5 eSIM activation requires an internet connection.
4. AI SaaS Service Non-Refundable Cases
Refunds will not be issued in the following cases:
• The eSIM was activated and used for data or calls
• Incorrect purchase due to user error (wrong destination or plan)
• Expired eSIM or AI subscription (after validity period ends)
• Account terminated for fraud, abuse, or prohibited activities (Section 6.5)
• Fraudulent payment methods detected (stolen cards, compromised accounts)
• Chargebacks initiated after service delivery ("friendly fraud")
• Promotional or discounted credits unless proven defective
• AI-generated content already delivered and downloaded
• Travel insurance claims denied due to misrepresentation or fraud
4.1 Our AI SaaS provides users with access to AI-powered tools including:
AI Voice, Text, and Image generation
AI Social Media Suite (Facebook, X, Instagram, TikTok, LinkedIn, etc.)
AI Content Creation and Marketing Automations
Real-time AI Chat and API integrations
4.2 Access may be subscription-based, prepaid, or through enterprise accounts.
4.3 Users agree not to misuse AI outputs or violate any platform’s terms (e.g., Meta, LinkedIn, X, Google, TikTok, Telegram, Whatsapp).
5. Service Availability
5.1 Simigo aims for 99.9% uptime but does not guarantee uninterrupted service.
5.2 eSIM performance depends on partner network providers in each region.
5.3 AI features depend on third-party AI engines (e.g., OpenAI, Azure, Amazon Bedrock).
6. User Obligations
Users agree to:
Use the Services lawfully and ethically.
Not resell eSIMs or misuse AI outputs.
Not attempt unauthorized access, scraping, or reverse engineering.
Respect third-party intellectual property and data protection rules.
Fraud, Abuse, and Prohibited Activities
You expressly agree that the following activities constitute material breach of this Agreement and will result in immediate account termination, forfeiture of all wallet credits, and potential legal action:
a) Payment Fraud
• Use of stolen credit/debit cards, compromised accounts, or unauthorized payment methods
• Initiation of fraudulent chargebacks after receiving service ("friendly fraud")
• Use of gift cards obtained through theft or unauthorized means
b) Service Abuse
• Reselling eSIM data/VoIP numbers without written authorization
• SIM box fraud or VoIP traffic pumping to evade carrier rates
• Using virtual numbers for spam, phishing, or illegal telemarketing
• Creating multiple accounts to exploit promotions or bypass restrictions
c) Identity Fraud
• Providing false identity documents for KYC verification
• Impersonating another person or entity
• Using stolen passports/IDs to activate services
d) Travel Insurance Fraud
• Filing false claims for non-existent trips or incidents
• Misrepresenting trip details to obtain coverage
Consequences of Fraud Detection:
Upon detection of any prohibited activity:
✓ Immediate termination of all services (eSIM, VoIP, subscriptions) without notice
✓ Full forfeiture of all wallet credits, prepaid balances, and unused data/VoIP minutes
✓ No refunds issued for any payments made (including partial usage)
✓ Liability for chargeback fees ($25–$100 per dispute) + 15% penalty on disputed amount
✓ Reporting to authorities: We will share evidence with payment processors (Stripe/PayPal), law enforcement, and carrier partners
✓ Civil recovery: We reserve the right to pursue legal action for damages exceeding $500
7. Payment and Refund Policy
7.1 All payments are processed through secure gateways (Stripe, PayPal, etc.).
7.2 All eSIM and SaaS products are prepaid and non-transferable.
7.3 Refunds are only applicable if the eSIM has not been activated.
7.4 Refunds must be requested within 14 days of purchase and reviewed case-by-case.
7.5 Fraud Enforcement & Wallet Forfeiture
a) Wallet Credit Forfeiture
All credits loaded into your Simigo wallet (via payment, gift cards, or promotions) are held in escrow until services are rendered. Upon fraud detection, 100% of wallet balance is immediately forfeited without refund or appeal. This includes:
• Unused eSIM data balances
• Prepaid VoIP/virtual number credits
• Gift card redemptions
• Promotional credits
b) Chargeback Liability
If you initiate a chargeback after receiving service:
• You forfeit all wallet credits immediately
• You are liable for Stripe/PayPal chargeback fees ($15–$100) + 15% penalty on transaction value
• We will submit evidence of service delivery to your bank/card issuer
• Repeated chargebacks will result in permanent ban + reporting to fraud databases (e.g., Ethoca, Verifi)
c) No Refunds for Fraudulent Accounts
Per Section 4 of our Refund Policy, no refunds will be issued if:
• Fraudulent payment methods were used
• Account was terminated for prohibited activities
• Chargebacks were initiated in bad faith
8. Data Protection and Privacy
8.1 Simigo processes personal data to provide and improve its Services in accordance with our Privacy Policy.
8.2 AI-generated or uploaded data may be processed by third-party APIs under data protection agreements (e.g., GDPR, CCPA).
8.3 We do not sell or share personal data with third parties for marketing purposes.
9. Intellectual Property
9.1 All software, algorithms, branding, text, graphics, and AI models are the property of Telmobil Inc / Simigo.ai.
9.2 You retain rights to content you generate through our AI tools.
9.3 You grant us a limited license to store and process your data for service delivery.
10. Limitation of Liability
10.1 Simigo shall not be liable for:
Network interruptions or third-party provider outages,
Data loss, indirect, incidental, or consequential damages,
AI output accuracy or misuse.
10.2 Our total liability shall not exceed the amount you paid in the preceding 12 months.
11. Governing Law and Jurisdiction
11.1 These Terms are governed by the laws of England and Wales.
11.2 Any disputes shall be subject to arbitration in London, United Kingdom.
12. Amendments
12.1 We may update these Terms periodically. Continued use constitutes acceptance of changes.
12.2 Updates will be posted on simigo.ai/legal with revision dates.

FRAUD WARNING: By paying this invoice, you agree that fraudulent activity (stolen cards, chargebacks after service delivery, identity theft) will result in immediate account termination, 100% forfeiture of all wallet credits, and liability for chargeback fees + penalties. Fraud cases will be reported to Stripe, PayPal, and law enforcement. Governing law: State of New York.
